Customer Contact Data Notice
THE CUSTOMER CLUB CUSTOMER CONTACT DATA NOTICE
The Customer Club Solution (the “Solution”), a cloud-based software as a service platform, helps our customers (“Customer”) provide marketing and communications regarding their business across multiple medias. Each of our Customers can upload their respective current and prospective customer’s (each a “Contact”) personal information for the purpose of communicating with such Contacts and managing certain marketing communications with each of them. We require our Customers to use the Solution only for permission-based marketing, in compliance with our Acceptable Use Policy. If you believe you have received unwanted, unsolicited messages sent through the Solution (or seemingly sent through our Solution), please forward a copy of that message with your comments for review to the following: support@the customerclub.io
Personal information and other data uploaded, by or on behalf of a Customer, including Contact information (which may include email addresses and other information regarding a Contact and content (including the content of a Customer’s campaigns) (collectively, “Contact Data”), belongs to and is controlled by the applicable Customer who collected and uploaded such Contact Data. The Customer Club strictly prohibits Customers from buying, selling, and or renting any of their Contacts’ personal information. Capitalized terms not otherwise defined herein shall have the meaning ascribed to them in the Customer Club Terms and Conditions.
The Customer Club acts as a service provider or processor to its Customers, including when we offer to our Customers various products and services, through which our Customers (or their affiliates): (i) create their own websites and applications running on our Solution; (ii) sell or offer their own products and services; (iii) send electronic communications to their Contacts through the Solution; or (iv) otherwise collect, use, share or process a Contact’s personal information via the Solution.
When acting in this capacity, we process Contact Data on behalf of our Customers, and we have no direct relationship with our Customer’s respective individual Contacts, who use one or more of our Customers’ services or products or visit such Customer’s websites We do not process Contact Data except as provided in our online user agreements with our Customers, available here.
The Contact Data that we handle, on behalf of our Customers, is collected through our Customers’ independent use of the Solution. For example, our Customers may use the Solution to encourage their respective Contacts to sign up for such Customer’s email or SMS lists.
Collection of Contact Data
Contact Data Provided by our Customers
Our Customers may upload lists of their Contacts, including their mobile #, email addresses, names, and other Contact Data, into their individual Customer Club account, We may also collect our Customers’ contacts’ demographic data, shopping histories and details about such Contacts’ interactions through our marketing communications. Our Customers use the Solution to send communications to people on their Contact lists. We do not share Contact Data uploaded by a Customer with any of our other Customers, nor do we communicate to our Customers’ Contact Data for our own purposes.
Contact Provided “Contact Data”
We will have a Contact’s personal information, such as the Contact’s email address, mobile number and other Contact Data under the following circumstances:

If the Contact signs up to receive communications (inclusive of texts and/or emails) from one or more of our Customers, including by means of a sign-up form or link;

If the Contact registers for an event held by one of our Customers; or
-
If the Contact otherwise submit their email address, mobile number or other information to one of our Customer by means of the Solution.
The Customer Club also receives information directly from Contacts when the Contact interacts with one of our Customer’s campaigns, or other Solution features or programs employed by the Customer as part of the Customer’s campaign, including when a Contact signs up to our Customers’ email or SMS/Text messaging lists. We hold any data received as part of campaigns on behalf of our Customer, and as such you need to contact our Customer if you have any questions.
Customer campaigns transmitted through the Solution may include a web beacon. This web beacon and other tracking technologies also allow us to collect log data, including your IP address, browser type and version & other information. We may share information, with our Customers so they can optimize their campaigns, customize offerings to their respective Contacts and understand a Contact’s level of engagement with them.
How we use Cookies
Some features of the Solution and related website are designed to give those Contacts who visit our website a better online experience and will only work if we use cookies. We also use cookies to collect information about Contacts’ online preferences. Cookies are text files which contain small pieces of information, sent by a web server to a web browser which allows the server to uniquely identify the browser on each page. They will be stored on a Contact’s computer, tablet, or phone when a Contact visits a website. Cookies may contain identifying information. Cookies enable us to gain information about the use of the Solution and related website. This information may be analyzed by third parties on our behalf.

Strictly Necessary Cookies
These cookies are essential in order to enable Contacts, to move around the website and use its features. Without these cookies, requested services, such as remembering a Contact’s respective login details or shopping basket items, cannot be provided.
Performance Cookies
These cookies collect anonymous information on how people use the Solution and related website. For example, we use (e.g.- Google Analytics) cookies to help us understand how Contacts arrive at our site, browse or use our site and highlight areas where we can improve areas such as navigation, shopping experience and marketing campaigns. The data stored by these cookies never shows personal details from which Contact’s individual identity can be established.
Functionality Cookies
These cookies remember choices a Contact makes, such as the country the Contact respectively visits our website from, language and search parameters such as size, color or product line. These can then be used to provide a Contact with an experience more appropriate to the individual selections made and to make the visits more tailored and pleasant. The information these cookies collect may be anonymized and they cannot track a Contact's browsing activity on other websites.
Targeting Cookies or Advertising Cookies
These cookies collect information about a Contact’s browsing habits in order to make advertising more relevant to such person and their interests. They are also used to limit the number of times you see an advertisement as well as help measure the effectiveness of an advertising campaign. The cookies are usually placed by third party advertising networks. They remember the websites a Contact visits, and that information is shared with other parties such as advertisers. For example, we may use third party companies such as Facebook and Google Tag Manager to provide a Contact with more personalized advertisements when visiting other websites.
The Customer Club may use Hotjar (first party cookie), a web analytics service. Hotjar may record mouse clicks, mouse movements and scrolling activity. Hotjar does not collect Contact’s personally information which the Contact did not voluntarily enter in this website. Hotjar does not track your browsing habits across websites which do not use Hotjar services. We may use the information collected by Hotjar service to improve our website, make it more user-friendly and monitor that it is performing correctly.
Social Media Cookies
These cookies allow a Contact to share what Contact has been doing on the website on social media such as Facebook and Twitter. These cookies are not within our control. Please refer to the respective privacy policies for how their cookies work.
Google Analytics
We may also use third party services such as Google Analytics and Matomo to collect information about visitors to our websites. This information is aggregated to determine number of visits, average time spent, pages viewed, etc. We use this information to measure site usage, as well as to improve the content and value of our site.
Other Cookies
The Website may contain media files from third party websites such as but not limited to Youtube.com and Vimeo. By playing these media files cookies can be placed by the third party. Furthermore, the Website offers the option to share certain information via social networks like Facebook.com, LinkedIn.com, WhatsApp or Twitter.com. The use of these functionalities, is subject to the terms and conditions, privacy and cookie policy of Facebook.com, LinkedIn.com, WhatsApp or Twitter.com respectively.
b. Deletion of Cookies and More Information about Cookies
Some cookies are deleted when a Contact closes their respective browser (session cookies). Others remain on a Contact’s respective device until they expire, or the Contact deletes them from the Contact’s respective cache (persistent cookies or tracking code) and enable us to remember things about the Contact as a returning visitor.
If a Contact wants to delete any cookies that are already on their respective computer, they should refer to the help and support area on their internet browser for instructions on how to locate the file or directory that stores cookies. The help option on the toolbar of most browsers will explain how to prevent a browser from accepting new cookies, how to have the browser notify a Contact when it receives a new cookie, or how to disable cookies altogether. Please bear in mind that some personalized services may not be available if Contact chooses to disable cookies. Please note that by deleting our cookies or disabling future cookies a Contact may not be able to access certain areas or features of our site.
c. Web Beacons
Some of our web pages may contain electronic images known as Web beacons (sometimes known as clear gifs) that allow us to count users who have visited these pages. Web beacons collect only limited information which includes a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides. We may also carry web beacons placed by third-party advertisers. These beacons do not carry any personal information and are only used to track the effectiveness of a particular campaign.
Use and Sharing of Contact Data
We will never email our Customers’ Contacts for our own purposes. We provide information we collect about a Contact’s interaction with the Solution to the applicable Customer and may use it on behalf of such Customer to provide or improve our services and/or in connection with our security and compliance programs.
We may share a Contact’s personal information with our service providers who develop certain features and functionality that integrate with our Solution, provided that such sharing is authorized by the relevant Customer. This allows us to make certain features of our services available to our Customer. We impose obligations on our service providers to ensure they use Contact Data in a manner consistent with our use and consistent with applicable privacy laws.
We may also disclose a Contact’s personal information as required by law, such as to comply with a subpoena or other legal process.
We are located in the United States, however Contact Data and communications may be transferred to and maintained on servers or databases located outside a Contact’s respective state, province, or country. Additionally, we may process and store such Contact’s personal information via our vendors in multiple locations, including without limitation, the United States, Canada, the European Economic Area (“EEA”) and other countries.
Although we will make all reasonable efforts to ensure a Contact’s personal information is protected in accordance with our obligations, the laws in these countries may not be as protective of privacy laws in an individual Contact’s location. Personal information processed and stored in another country may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws.
Choice/Opt-Out
Contacts may opt out of text messaging sent to them from one of our Customers simply by replying “STOP” to the number that sent the applicable message.
Requests Related to Your Personal Information
We do not own the Contact Data held by each of our individual Customers. We are a “data processor” or “service provider”, which means that we have an obligation to keep your Contact Data safe and secure. We take instructions from our individual Customers who are the “data controllers” or “businesses” (to the extent such privacy laws apply to them) to send communications on their behalf and to assist them with fulfilling data subject rights requests made directly to them, such as correcting or deleting an individual’s Contact’s personal information. If a Contact’s personal information is held in our database, it is our Customer’s responsibility to deal with a Contact’s request in their role as a data controller and to the extent necessary, we will support them.
If a Contact has a query or would like to make a data subject rights request under applicable privacy laws, we recommend that a Contact reply to the email address or text message on the communication actually received for further information as we are unable to provide any additional information about our Customers.
