The Customer Club – An Overview

The Customer Club Solution (the “Solution”), a cloud-based software as a service platform, helps our customers (“Customer”, “you”, “your”) provide marketing and communications regarding their business across multiple medias. Our Customers can upload to and use the Solution to reach their existing and prospective customers (each a “Contact”), for instance, through email and other channels. Personal information and other data regarding a Customer’s Contacts, including Contact lists (which may include email addresses and other information for a Customer’s Contact(s) and content (including the content of a Customer’s campaigns) (collectively, “Contact Data”), belongs to and is controlled by the Customer who collected and uploaded such Contact Data. The Customer Club strictly prohibits our Customers from buying, selling, and or renting any of their Contacts’ personal information. Capitalized terms not otherwise defined herein shall have the meaning ascribed to them in the Customer Club Terms and Conditions.The Customer Club acts as a service provider or processor to its Customers, including when we offer to our Customers various products and services through which our Customers (or their affiliates): (i) create their own websites and applications running on our Solution; (ii) sell or offer their own products and services; (iii) send electronic communications to their Contacts through our Solution; or (iv) otherwise collect, use, share or process personal information via our Solution.

When acting in this capacity, we process Contact Data on behalf of our Customers, and we have no direct relationship with our Customer’s respective Contacts/end-users who use our Customers’ services or products or visit our Customers’ websites. We do not process Contact Data except as provided in our Terms and Conditions with our Customers, available here

The Contact Data that we handle, on behalf of our Customers, is collected through our Customers’ independent use of the Solution. For example, our Customers may use the Solution to encourage their respective Contacts to sign up for the Customer’s email or SMS lists. For more information about how we process Contact Data, please review our Customer Contact Data Notice.  

Each of our Customers is responsible for their own privacy and data security practices, including with respect to the personal information each Customer collects from its Contacts and/or uploads to Solution  In accordance with The Customer Club Terms and Conditions , each of our Customers is required to maintain and post a privacy policy regarding the Customer’s collection and use of their Contact’s personal information and Terms of Use regarding applicable SMS marketing practices.  Please note coupons and offers sent through the Customer Club include a link to a “Powered by The Customer Club” footer that links to our website with information about the Customer Club’s Privacy Policy. This information is not meant to be, nor should it be interpreted as, a substitute for each Customer’s own privacy policy and terms and conditions of use.  If you are a Contact of one of our Customers whose personal information we process and you are seeking to exercise your data rights, you should Contact our Customer directly.

1. Information Covered By This Privacy Notice

This privacy notice only applies to our Customer’s personal information.  It does not apply to any of our Customers’ Contacts’ personal information included in the Contact Data.

The following Privacy Policy explains how the Customer Club and the Solution collects, uses, protects, and discloses information and data when our Customer uses the Solution or website, or provides personal information to us, or signs up to use Solution.

 

2. What Personal Information is Collected

For the purposes as mentioned hereafter, Customer Club may gather and process the following categories of personal information about you:

o Name, title, address;
o Contact details (e-mail, phone number);
o Company;
You may also choose to provide additional/optional information when completing forms on the Solution or that you give us when we have communications with you (by telephone, by e-mail or at trade fairs or events). Furthermore, we may also collect, and process information obtained through our websites or the devices you are using. This information can be:
o Location data (location information collected from social media networks or IP addresses from your device; GPS signals sent by a mobile device);
o Information from cookies, web beacons or from the internet. This information will be gathered automatically and may be the website that you have visited before browsing our website or the website that you are visiting after ours. We may also collect information on which pages of our website you are visiting, your IP addresses, type of browser, access times, operating system and more. You can find out more about how we do that in Section 6 “How we use Cookies” (set forth below);
o Data we obtain from other websites, for example if you ask us to connect with your Facebook account;
o We may record any telephone calls for quality assurance and for training purposes;
o We may also collect publicly accessible information in order to verify information we have collected and to manage and expand our business.

 

3. Why Do We Collect This Information

We collect the abovementioned information to understand your needs and to provide you with a better service, and more specifically we collect your information for the following purposes:

o Your personal information will be used to respond to your (online) queries about the Solution , to provide you with information on the Solution , and to follow-up online offers;
o Provide the Solution  you have ordered;
o Verify your identity and financial data for payment for the Solution ;
o The information will be used to improve the Solution ;
o Investigate complaints about the Solution  or regarding our website;
o Meet legal, regulatory and compliance obligations and requirements;
o Analyze and monitor the use of accounts to prevent, investigate fraud, terrorism, misrepresentation, security incidents or crime and/or report this to the competent authorities;
o Sending promotional e-mails periodically about the Solution , about special offers or other information which we think that it might be interesting for you;

o Personalize your experience and to deliver you content and offers relevant to your interests, including targeted offers and ads through the Solution, on third party sites and via e-mail and text messages (with your consent, as may be required by law, push notifications, and other similar means;

o Run contests, promotions, and sweepstakes;

o Measure and understand Solution metrics, such as website traffic and its sources and conversions in order to gauge the effectiveness of online marketing;
o Contacting you for market research purposes from time to time;
o Process your personal information for specific purposes as mentioned on specific forms as published on our website, on written notices or via e-mail;
 

4. How Will Your Information Be Used and Shared

The Customer Club may share your personal information:

o with companies in our group and/or our affiliates that may exist now or in the future; or
o with any third party you have asked us to share your personal information with – such as Facebook or any other social media site if you have asked us to connect with your account; We can also share your personal information, based on our legitimate interest, to third party providers who help us with our products and services. Examples include hosting our web servers, analyzing data, providing marketing assistance, and providing customer service. These companies will have access to your personal information but only when strictly necessary to perform their functions and they may not use that data for any other purpose. Your personal information will not be sold or rented to third parties.
 

We may disclose your personal information to enforce our policies, to comply with our legal obligations or in the interests of security, public interest, or law enforcement. If The Customer Club or its assets are sold or integrated with another business, your personal information details will be disclosed to any prospective purchaser’s adviser and will be transferred to the new owners of the business. In this case, we will implement the appropriate safeguards to ensure the integrity and confidentiality of your personal information. However, use of your personal information will remain subject to this Policy.
 

5. Transfer and Storage of Your Personal Information

Please be aware that your personal information and communications may be transferred to and maintained on servers or databases located outside your state, province, or country. Additionally, we may process and store such personal information via our vendors in multiple locations, including without limitation, the United States, Canada, the European Economic Area (“EEA”) and other countries.

Although we will make all reasonable efforts to ensure your personal information is protected in accordance with our obligations, the laws in these countries may not be as protective of your privacy as those in your location. Personal information processed and stored in another country may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws. By using Solutions, you are agreeing to the collection, use, transfer, and disclosure of your personal information and communications will be governed by the applicable laws in the United States and/or the applicable country of processing.


6. How We Use Cookies

Some features of the Solution and related website are designed to give you and those of your Contacts, who visit our website (individually, a “Visiting Contact” and collectively, the “Visiting Contacts”), a better online experience and will only work if we use cookies. We also use cookies to collect information about the online preferences for you and your Visiting Contacts. Cookies are text files which contain small pieces of information, sent by a web server to a web browser which allows the server to uniquely identify the browser on each page. They will be stored on your computer, tablet, or phone when you visit a website. Cookies may contain identifying information. Cookies enable us to gain information about the use of the Solution and related website. This information may be analyzed by third parties on our behalf.

These cookies are essential to enable you and your Visiting Contacts, to move around the website and use its features. Without these cookies, requested services, such as remembering your’ s or your Visiting Contact’s respective login details or shopping basket items, cannot be provided.

Performance Cookies
These cookies collect anonymous information on how people use the Solution and related website. For example, we use (e.g.- Google Analytics) cookies to help us understand how customers arrive at our site, browse, or use our site and highlight areas where we can improve areas such as navigation, shopping experience and marketing campaigns. The data stored by these cookies never shows personal details from which yours (or those of your Visiting Contact) individual identity can be established.

Functionality Cookies
These cookies remember choices you (or your Visiting Contact) make such as the country you (or your Visiting Contact) respectively visit our website from, language and search parameters such as size, color, or product line. These can then be used to provide you (or your Visiting Contact) with an experience more appropriate to the individual selections made and to make the visits more tailored and pleasant. The information these cookies collect may be anonymized and they cannot track your (or your Visiting Contact's) browsing activity on other websites.

Targeting cookies or advertising cookies
These cookies collect information about your browsing habits to make advertising more relevant to you and your interests. They are also used to limit the number of times you see an advertisement as well as help measure the effectiveness of an advertising campaign. The cookies are usually placed by third party advertising networks. They remember the websites you (or your Visiting Contact) visit, and that information is shared with other parties such as advertisers. For example, we may use third party companies such as Facebook and Google Tag Manager to provide you (or your Visiting Contact) with more personalized advertisements when visiting other websites.

The Customer Club may use Hotjar (first party cookie), a web analytics service. Hotjar may record mouse clicks, mouse movements and scrolling activity. Hotjar does not collect personal information that you (or your Visiting Contact) did not voluntarily enter in this website. Hotjar does not track your browsing habits across websites which do not use Hotjar services. We may use the information collected by Hotjar service to improve our website, make it more user-friendly and monitor that it is performing correctly.

Social Media Cookies
These cookies allow you (or your Visiting Contact) to share what you (or your Visiting Contact) have been doing on the website on social media such as Facebook and Twitter. These cookies are not within our control. Please refer to the respective privacy policies for how their cookies work.

Google Analytics
We may also use third party services such as Google Analytics and/or Matomo to collect information about visitors to our websites. This information is aggregated to determine number of visits, average time spent, pages viewed, etc. We use this information to measure site usage, as well as to improve the content and value of our site.


Other Cookies

The Website may contain media files from third party websites such as but not limited to Youtube.com and Vimeo. By playing these media files cookies can be placed by the third party. Furthermore, the Website offers the option to share certain information via social networks like Facebook.com, LinkedIn.com, WhatsApp or Twitter.com. The use of these functionalities, is subject to the terms and conditions, privacy, and cookie policy of Facebook.com, LinkedIn.com, WhatsApp or Twitter.com respectively.

b. Deletion of Cookies and More Information About Cookies

Some cookies are deleted when you (or your Visiting Contact) close your respective browser (session cookies). Others remain on your (or your Visiting Contact’s) respective device until they expire, or you (or your Visiting Contact) delete them from your (or your Visiting Contact’s) respective cache (persistent cookies or tracking code) and enable us to remember things about you (or your Visiting Contact) as a returning visitor.


If you (or your Visiting Contact) want to delete any cookies that are already on your respective computers, please refer to the help and support area on your internet browser for instructions on how to locate the file or directory that stores cookies. c. Web beacons
Some of our web pages may contain electronic images known as Web beacons (sometimes known as clear gifs) that allow us to count users who have visited these pages. Web beacons collect only limited information which includes a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides. We may also carry web beacons placed by third-party advertisers. These beacons do not carry any personally identifiable information and are only used to track the effectiveness of a particular campaign.

However, no data transmission over the Internet or other network can be guaranteed to be 100% secure, and no security measures can provide absolute protection. As a result, while we strive to protect information transmitted on or through this website or the Solution, we cannot and do not guarantee the security of any information you transmit on or through this website, the Solution, or that you otherwise provide to us, and you do so at your own risk.

This website may contain links to third party websites. The Customer Club is not responsible for the content of these third-party websites and is not responsible for the privacy standards and practices of that third party. We recommend you read and understand the relevant privacy policies of these third parties and their websites before you accept their cookies and visit their website to ensure yourself that your personal information is sufficiently protected.


9. Managing your Marketing Preferences

You can opt out of receiving marketing e-mails from us by following the Unsubscribe link provided at the bottom of the marketing e-mails you receive from us or by texting STOP to our text messaging. You can opt out of receiving marketing e-mails or texts from us, however, if you continue to use our services, we will still need to email you from time to time about your account. Note: If you provide your personal information to a client of ours through your use of one of our Services, in such case, the collection and processing of your personal information may be subject to the privacy policy of such third party.

10. Managing Your Profile Information

You can review and change your Personal Information by logging into the Website and visiting your account profile page. You may also send us an e-mail at support@thecustomerclub.io to request access to, correct, or delete any Personal Information that you have provided to us. If we cannot delete your Personal Information without deleting your account, you understand we will delete your account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Please be aware that whenever you share information on any public area of the Solution or website, that information may be accessed by others. In addition, please remember that when you share information in any other communications with third parties, that information may be passed along or made public by others. This means that anyone with access to such information can potentially use it for any purpose, including sending unsolicited communications. We cannot control and are not responsible for what such third parties may do with your information, so you should exercise caution when choosing to share it.

 

11. Changes to this Policy

The Customer Club may amend and update this Policy from time to time to ensure that the Policy represents the way we process your personal information at that time. We will place an updated version of this Policy on the same webpage and will automatically be effective when published. Please return to this webpage regularly to ensure that you are always aware of the information we collect and process, how your data is being used, in which circumstances, and in which cases we will share your data with third parties.

The Customer Club cannot guarantee or verify the contents of any externally linked website. Users should therefore note they click on external links at their own risk, and the Customer Club cannot also be held liable for any damages or implications caused by visiting any external links mentioned.
